A 19 YEAR-OLD Gweru teenager was lucky to escape jail on Wednesday after he was acquitted for raping a 15 year old girl.

Mgcini Moyo of Clifton Park, Gweru was acquitted on charges of raping the teenage girl but convicted for having sex with her as a minor.

Regional magistrate, Morgan Nemadire slapped him with a wholly suspended three year sentence for five years on condition of good behaviour.

Nemadire ruled that it was clear from the complainant’s testimony that Moyo was in love with her and they had consensual sex but said that sex with minors should be condemned at all costs.

The court heard that Moyo and the girl were in love for almost a month and the girl would frequent his place of residence on several occasions. He had promised to marry her.

The state had alleged that on the 27th October, 2014, the girl was on her way to fetch water when she met Moyo who asked her to accompany him to his place of residence.

When they got home, Moyo asked the girl to have sex with him and she declined.

According to prosecutors, Moyo then pushed her onto the bed before raping her once. After the alleged attack, the girl dressed up and proceeded to fetch water before returning to her home.

On November 2, she reportedly told her mother that Moyo had raped her and a police report was made leading to his arrest.
