A SODOMY accused MDC-T councillor’s bail hearing was delayed to Wednesday after presiding magistrate Milton Serima excused himself due a bereavement.

Harare Ward 33 Budiriro councillor Sydney Chirombe, 49, is in custody on allegations of sodomy after allegedly being caught having sex with a male partner a week ago.

Serima was Tuesday said to be attending the burial of Tsholotsho resident Magistrate Carrington Karidzagunda who was laid to rest in Norton.

Prosecutor Sharon Mashavire deferred the matter to May 21.

It is the state’s case that Chirombe was apprehended together with sex partner, Joseph Muchena, 23, whilst in the act by alert police details patrolling the Willowvale industrial area.

In his application for bail, defence lawyer Shadreck Chisoko argued that Muchena in particular is a proper candidate for bail because he was not a flight risk.

Said Muchena in his papers: “I am not a flight risk and do not plan to abscond trial. There is no one to bring me food at remand (prison) and there is no food and blankets at prison.”

The state’s case also seems to be hanging by a thread after revelations that a medical report presented as evidence apparently showed that there was no anal penetration, putting into doubt the prospects of a conviction.

Police officers allegedly approached a stationary Toyota Noah car parked along Godwin Road. Upon inquiring they allegedly caught the pair having sex on the front passenger seat.

The incident is alleged to have happened on May 15 around 0230hours.

Chirombe is not new to sodomy-related controversy after he allegedly forced himself on a driver in a boathouse in Kariba early this year. He was acquitted of the charge.

The MDC-T councillor was also released from prison early this year on charges of killing a police officer in May 2011 and had been in jail for almost two years.
