SUNDAY Mail editor Edmund Kudzayi failed with a fourth bid for refusal of remand Monday even as the State continuously fails to come up with a trial date.

“We are going to the High Court,” a frustrated Kudzayi told NewZimbabwe.com. “This charade has gone on for long enough.”

The brothers deny the allegations.

They were arrested in July 2014 but the State still fails to come up with a trial date with prosecutors claiming investigations are continuing.

On Monday Harare Milton Serima magistrate rejected their application to be removed from the remand.

Their lawyer, Admire Rubaya, had last Friday, argued that his clients’ constitutional right to a trial within a reasonable time had been violated.

But Serima dismissed the application saying the State needed time to investigate what he described as a complex case.

“The court is convinced that the State, through the investigating officer, faces one of the most intricate cases in nature which needs more time to investigate.

“The period they have stayed on remand cannot be said to be unreasonable based on the circumstances. Therefore the application is dismissed.”

Serima remanded the brothers to May 29.
