Three siblings will serve 24 months in prison after they were last week convicted of culpable homicide by Harare magistrate Mr Themba Kuwanda. Tasara(21), Thanks(25) and Answer(27) Mushumba were initially sentenced to 30 months imprisonment before Mr Kuwanda suspended six months for five years on condition that the three do not commit an offence involving violence during that period. Mr Kuwanda warned the trio that if they committed the same offence again during the five years, they would face a custodial sentence without the option of a fine.

Circumstances leading to the conviction of the trio are that sometime in October 2008, the now deceased Charles Nyabereka was at Cape to Cairo Nightclub drinking beer with some friends and when they decided to go home. A misunderstanding then arose between Thanks and Nyabereka and they began to fight. It is alleged that Tasara and Answer came to their brother’s assistance, punching and kicking Nyabereka.

The court heard that, one or all of the three brothers hit Nyabereka on the head before he fell on the ground where he died on the spot.

A post mortem conducted on Nyabereka’s body indicated that he had died from head injuries (subdural haematoma) associated with the assault.
