An unlicensed commuter omnibus driver who hit a Guard Alert security guard after failing to observe a give way sign was last Friday sentenced to one year eight months in jail.Shawn Masakure (24) of Overspill in Epworth, Harare, pleaded guilty to two counts of driving without a licence and negligent driving.

He appeared before Chitungwiza magistrate Mr Lazarus Murendo, who sentenced him to three years in prison, but 16 months of the sentence were suspended on condition that in the next five years Masakure does not commit a similar offence.

In passing sentence, Mr Murendo noted that a lot of deaths were being caused by commuter omnibus drivers.

“You risked people’s lives by driving a public service vehicle without a licence,” he said. “A deterrent sentence is, therefore, called for to deter would-be offenders.”

Prosecutor Mr Norman Koropi proved that on March 7 this year, Masakure was driving a Mercedes Benz sprinter at Overspill Shopping Centre in Epworth.

At a certain point along the road to the shopping centre, the court heard that Masakure turned right into a T-junction.

Masakure reportedly hit Gibson Tsakatire, who was cycling along the road, and trapped him under the vehicle.

The court heard that passengers aboard the bus disembarked and rushed to pull Tsakatire out.

As a result of the accident, Tsakatire sustained injuries and the matter was reported to the police.
