HARARE, Members of Zimbabwe's National Assembly have accused the government of disregarding the new Constitution by implementing certain Statutory Instruments which go against the provisions of the supreme law of the land.

The MP for the ruling Zanu PF party for Hurungwe East constituency, Sarah Mahoka, queried why the government continued to regard persons born in Zimbabwe of parents who are of foreign descent but live in the country as aliens and why they are asked to pay a 40 US dollars fee to renounce their foreign citizenship.

She said this was contrary to section 35 of the Constitution which protects the citizenship status of children born in Zimbabwe under those circumstances.

Home Affairs (Interior) Deputy Minister Obedingwa Mguni said his ministry was only enforcing a provision originated by the Ministry of Finance. We have got a statutory instrument -- I remember it is from 2009 -- whereby we agreed that the alien can turn their birth certificates or ID's by paying a 40-dollar fee, he said, highlighting the need for urgent alignment of laws to the Constitution.

This attracted the ire of several other MPs, including proportional representation MP Priscilla Misihairabwi Mushonga of the MDC-N and Zanu PF's Zvimba West MP, Ziyambi Ziyambi, who reminded Mguni of the supremacy of the Constitution.

I want to draw the deputy minister to section two of the Constitution on supremacy of the Constitution. It says this Constitution is the supreme law of Zimbabwe, (and that) any law, practice, custom or conduct inconsistent with it is invalid to the extent of its inconsistency," said Ziyambi.

"We have glorified this creature of alignment of laws and the majority of us have decided not to abide by the Constitution and glorify the creature called the alignment of laws. The Constitution is very clear that if you are a Zimbabwean you get a

birth certificate without paying a penny."

The deputy minister promised to urgently look into the matter and rectify it. I have to call an urgent meeting within our ministry to spell out that thing and rectify what is happening.
